Save lives! Equal Retribution

Student of Al Huda
One of the most beautiful aspects of Islam is that the sympathy of the people lie with the one who is wronged not the one who carries out the injustice. Due to this reason equal retribution is allowed and prescribed upon the muslims. The family of a murdered person have two choices when it comes to dealing with the one who killed their family member.
The first option is that they are allowed to ask for the death of the person who killed their loved one. It does not matter whether the person is a slave or a female, that person must pay for what they did. No one else can be killed in place of the murdered. For example if you are unable to find the murdered you can not kill his wife in place of him, it must be the one who committed the crime that has to pay.
The second option is that they can forgive the murderer for his crime and overlook from him. Allah says about this:
But whoever overlooks from his brother anything, then there should be a suitable follow-up and payment to him with good conduct. This is an alleviation from your Lord and a mercy. But whoever transgresses after that will have a painful punishment. [Al Baqarah:178]
The murderer will give something that is called blood money. This is a certain amount of wealth that is given to the family of the lost one and they in turn forgive the sin of the person. Allah says this is a mercy from Allah on the person who killed the other as he is saved from death himself. However, once the blood money is taken the other family can not turn around and kill the one who murdered their family member as Allah refers to this as transgression and for those that transgress is a painful punishment.
The wisdom of equal retribution is given:
And there is for you in legal retribution [saving of] life, O you [people] of understanding, that you may become righteous. [Al Baqarah:179]
Equal retribution allows to save lives as less people will take the step to kill someone when they know what the consequence is. However, only the ones of understanding will see this and become righteous and those who are unable to understand they will not see the wisdom in this prescription for others. It is a mercy and a blessing that Allah takes the side of those who are wronged rather than those who do the wrong.
